US Court Orders Freedom of Abrego Garcia from ICE Custody

A court has ruled the prompt discharge of Kilmar Abrego Garcia from immigration custody, finding his ongoing detainment lacks lawful basis.

"Since Abrego Garcia's return from wrongful detention in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis wrote in her ruling.

The case originates in a erroneous deportation to El Salvador earlier this year, which the government later admitted was an error. After his repatriation to the United States to face alien smuggling allegations, he was held in immigration detention.

In her decision, the court pointed out that the authorities does not have a current deportation order, which prevents them from removing Mr. Abrego Garcia "at this juncture."
